FDA Responds To Vapor Lawsuits

Earlier this year the FDA released the final deeming regs which is already starting to cripple the vaping industry. Even though most of the new regulations won't take full effect for two years, vape shop owners and manufacturers everywhere are closing their doors to avoid jumping through all the hoops and paying the outrageous fees to stay in the market. 

It didn't take long for a few lawsuits to be filed against the FDA. At one point there were over nine groups with lawsuits filed. Several of the lawsuits were recently ordered to be consolidated by a federal judge. Nicopure labs and The Right to be Smoke-Free Coalition are now fighting together under one umbrella and this is the FDA's 101 page response to the case.

If you don't have the time to read through this short novel here's how it reads:

  • They claim that e-liquid has dangerous compounds in it
  • Mods are exploding in people's faces
  • Nicotine is the most addicted substance known to man
  • The FDA has a lot of money to throw at lawsuits
  • The FDA can be extremely smug when it comes to dealing with the vaping industry

To those of us who have read (and lived) through all the vaping success stories, this response comes off as more of a fear mongering tactic and misinformation campaign for the general public to consume. There isn't really a whole lot of fact based information to justify such a harsh plan to wipe out an entire industry.

If this case does see the light of day in court, it's going to be an uphill battle for us just clearing up all the unjust claims that the FDA has made to the public. What are your thoughts on the FDA's response? Shoot us a comment below and let your voice be heard!

I have battled quiting smoking for a long time I tried everything and nothing worked until vaping ever since I quit the cancer sticks and went to vaping my breathing is ten times better don’t cough like I use to and can taste better. My dad has smoked for years twenty or more years and switched as well to vape and has been Tabacoo free for a year all because of vaping. Vaping has saved my health in more ways then one the same with my dad. So for FDA to try and our rights to vape away is so heartbreaking and so wrong so there for I will stand with the vaping community and fight for our rights to vape

I smoked cigarettes since about 1980 or 1981. I started vaping in 2009 and what was available back then was not all that good but it helped me quit smoking. fast forward to 2016, I got some really good vaping gear and I understand things like Ohm’s law because I studied electronics for a while and I was a automotive technician up until 2007 so I was fortunate to have a mechanical and electronic background.

I can say the devices themselves are indeed safe to use if you get the right batteries and such for your mod.
as for the liquids we use like PG and VG liquids, these are used in food colorings and even used in breathing treatments and stuff to treat asthma. it is really absurd how the FDA is classifying the devices and even liquids with no nicotine present as a tobacco product.

as far as my health is concerned I breathe far better than I could in the majority of my whole life and no longer get winded climbing stairs or any other kind of stress. the FDA supporting big tobacco yet accuse this new technology as dangerous really shows their hypocrisy as they do not care if you die of lung cancer and heart attacks attributed to smoking but ignore the health improvements vaping is well known to produce.

we have to keep fighting them in this very unjust ruling!

I have been trying to quit cigarettes for more than 20 of the 40 years I had been smoking. Patches, gum, scarey pharma, and yes even cold turkey. Eventually I always started smoking again. Last year I finally took the plunge and bought electronic cigarettes for me and my spouse. He was not really interested in quitting cigarettes but was willing to give it a try.

It has been a year now and we are both still vaping No more stinky ashtrays or tar covered EVERYTHING. We don’t cough anymore and we didn’t get flu/colds last winter for the first time ever. I don’t even think about cigarettes anymore. I have been gradually decreasing my nicotine use since last December and am aiming for “0” by the end of this year.

We have come to enjoy the vaping experience, as long time smokers with 40 odd years a piece as smokers, we are used to being told where NOT to indulge our habits, vaping is no different, NON Vapors have a right to not have to breath VAPOR clouds if they don’t want to. Ditto the “FREE SAMPLES” yes it is sad to see them go away but it won’t affect my own habits if they do. (By the way….. shouldn’t cigarette manufacturers have the same rules?, we still get coupons for ’FREE" packs in the mail)

From my first vape, I have made a point of supporting Sellers and manufacturers who are committed to safety, and social responsibility, I plan to continue with that policy

I’ve went a full year without cigarettes after smoking for 11 years. As I scroll down this page looking at all these comments, why is FDA supporting cigarettes, why are they supporting cancer, why are they supporting major tobacco companies. What we should be asking is witch FDA official is having there pockets filled with cash by tobacco companies. When vaping first started the FDA and tobacco companies didn’t care tell after they seen there cigarette sales declining.

I just read all 101 pages. First off I quit cigarettes using a vape I smoked for almost 18 years. I tried to quit many times but went right back. I started vaping 3 years ago and have never touched a cigarette since then. And claim of them blowing up is user error why punish every one because some dumb ass dosent understan the limits of there device. That’s like saying well John doe crashed his car doing 100 mph because he didn’t know he should only be doing 70. So do we ban cars now because of a couple dumb asses. The fda is a money hungry freedom stealing corporate sobs. They took money from big Tabacco companies. If your big tabacco company was smart you would start making eliquid and jump on board instead of buying people off.

I have been TOBACCO free for 3 years after smoking for about 15 years. I developed asthma once I hit 30. Guess what caused the asthma. I’ll give you a hint, it wasn’t vaping. So, after many failed attempts to quit, I asked one of my friends about vaping. As soon as I got paid, I went down to the shop and got my starter kit. As they say, it’s all downhill from there. After 3 years, I have full smell and taste back. I can breathe easier, I don’t stink like an ashtray (however, I do occasionally smell like a cinnamon roll) and have had to use my rescue inhaler much less than at first. I don’t see how you can justify knocking an industry that helps save lives and promotes healthier alternatives. I’m disappointed in you as a whole. You are better than that.

I am 60 yr old, who smoked for 40+ years, 4 years ago i had to have open heart surgery to unclog my arteries, I was told i needed a triple by-pass and ended up having 7 and 4 stents put in place, I was told I had to quit smoking, not an east task for me, so i started vaping and have continued to do so for the past 4 years, it has kept me from smoking and i am so happy that vaping was available so i could continue to remain tobacco free. The FDA has issues, the tobacco industries are loosing money because of vaping, and i am all for that since we all know for a fact that they do cause cancer and kill people, Hey FDA wake the hell up, you approved cigarettes which are killing people and didn’t blink an eye and are now fighting to regulate something that is helping people to remove tobacco from their lives giving them a chance to live longer with out the cigarettes that are outrages in price, killing people, causing cancer, all of this is FDA approved , sounds like you are all for supporting a product that is causing death and sickness to all humanity, be it from direct contact or indirect contact. Vaping had help me and my wife and several others in my family leave those nasty things called cigarettes, that you so gladly approved. I do have a question for all you FDA, are you loosing that much money that you are afraid of the tobacco company’s not supporting you? Do you not value the human life enough to leave something that is helping them leave tobacco alone. Does the tobacco really have that kind of strong hold on your wallets that you have to side with a company that is knowingly killing millions of people a year? Are you really OK with this? I say grow some balls and tell the tobacco company’s where to go and side with the one that is helping millions quit using cigarettes, and tobacco products. I think we all deserve to live a better life with out all the crap that you approved. I know for me, if it wasn’t for vaping i honestly don’t where i would be right now. but if i keep listening to the FDA and their approval suggestions, i would be dead.

I made the switch over five months a go and have been TABACCO free ever since. I feel so much helthier, I can breath, the circulation in my extremities are better! All this thanks to vaping. The FDA needs to get a grip…. They don’t care about our Heath…

My grandmother, who raised me, got lung cancer and spent a long time in hospice dying. I would drive 7 hours each Friday to see her. While there I would go outside and smoke. When I picked out her coffin, I walked out and smoked. When we had her funeral, I smoked. Then it dawned on me. Would my kids or grandkids be visiting me in hospice? Then my health insurance was raised bc I was a smoker. I researched alternatives and learned about Vaping. I called the insurance company and they told me if I went 12 months Vaping I would be considered tobacco free. I did not even know we had a shop here. One day I was driving home and I saw a small Uptown Vapor sign. I did a u turn and got my starter kit. Jeff helped me. The second visit I fell in love with Jeff. We grew the company and now have 3 stores and about 15 employees. My mission is to keep grandkids from having to go to hospice to visit their grandmas.

I have 15 employees that depend on our business for their livelihoods. With the FDA’s current regs we will have to fire over half of them.

We are unable to assist people in how to properly use devices, and help even change a coil. I bet if I still smoked most cashiers would light a cig for me.

Two things about the FDA, There nothing but a bunch of money hungry sons a bitchs that don’t give a Rats ass about you or I, money is there only concern, The FDA Needs to be completely broken down and Rebuilt.
